The courts have been especially active in determining tribal jurisdiction issues. From the rights of tribal governments to pursue civil tort claims against businesses under tribal jurisdiction to upholding tribal convictions and a tribe’s right to assert the regulation of alcohol of all residents within its original and undiminished boundaries. The courts have also created greater uncertainty around labor issues with a split on the applicability of National Labor Relations Board to tribal governments. In addition to providing an update, our legal experts will discuss pending cases that threaten economic security, including the sales and utilities tax challenges.
