Labor and employment law in Indian Country continues to provide new developments through recent National Labor Relations Board court decisions, The courts have created uncertainty on the application of the Fair Labor Standards Act (FLSA) to tribal governments and the new overtime rule that raises the salary threshold at which eligible workers qualify for overtime pay from $23,660 to $47,476 per year.
