Matthew Upton has been representing schools, cities and towns for over 20 years, specializing in employment matters, labor relations, general school law, and municipal law. He routinely defends schools and municipalities before the New Hampshire Public Employee Labor Relations Board (PELRB). He has also served as the Chairman of the New Hampshire Board of Claims, appointed by the Chief Justice of the New Hampshire Supreme Court (1994-2009). Matthew is the son of the late Richard F. Upton, who was regarded by many as New Hampshire’s original school/municipal lawyer.
Upon graduation from law school, Matthew served as a law clerk at the New Hampshire Supreme Court, where he was directly involved in some of the most important school law decisions including Appeal of the Sanborn Regional School Board, 133 New Hampshire 513 (1990). He was also instrumental in successfully defending a school district in the “guns in the yearbook” case which drew national attention. In addition, Matthew has handled establishment clause cases involving the interaction between religion and schools.
Matthew has successfully defended cases in the U.S. First Circuit Court of Appeals, U.S. District Court for New Hampshire, New Hampshire Supreme Court, New Hampshire Superior Court and the New Hampshire Department of Education. He has also presented at numerous conferences on topics such as, Conducting Investigations of Employee Misconduct, Right to Know Law, Collective Bargaining 2008.
As a municipal attorney, Matthew has represented communities in large scale development including a recent project involving the development of a 650,000 square foot Outlet Mall in southern New Hampshire, obtaining significant financial considerations for his client. He has also defended numerous zoning and planning cases with excellent results. Given his prior experience as a Town Administrator for two New Hampshire towns, Matthew thoroughly understands how important it is that legal advice provides practical, timely and efficient solutions.
